Foreign nationals who were usually residing in Ukraine on 24 February 2022 and are seeking protection from the ongoing war there, can currently enter Germany without a visa and stay in Germany without a German residence permit for up to 90 days.

However, an application for a German national residence permit has to be submitted to the the foreigners authority of the applicant‘s place of residence or whereabouts within 90 days following first entry into Germany.

Foreign nationals who have entered Germany on or before 03 June 2022 and have already resided there for a period of 90 day and are required to hold a German residence permit.

All persons who have already entered Germany on or before 03.06.2022 and have resided permanently in Germany since then must have already applied for a German residence title, as the maximum duration of stay of 90 days without a residence title in Germany has already expired.

The above regulations cover he following groups of applicants:

  • Ukrainian nationals residing in Ukraine prior to 24 February 2022 and their immediate family members regardless of them travelling on a biometric or non-biometric passport. This also applies if they were temporarily not residing in Ukraine on 24 February 2022 but had their place of residence or usual abode there on 24 February 2022.
  • Stateless persons and non-Ukrainian nationals with international or equivalent national protection in Ukraine prior to 24 February 2022.
  • Non-Ukrainian nationals who can prove that they were legally resident in Ukraine prior to 24 February 2022 on the basis of a valid unrestricted residence permit issued under Ukrainian law and who are not in a position to return safely and permanently to their country or region of origin. Non-Ukrainian nationals just temporarily visiting Ukraine on 24 February 2022 are not covered by the above exemptions.
  • Third-country nationals in Ukraine on the basis of a Ukrainian residence permit and whose family members are Ukrainian nationals, but who were not in Ukraine on 24 February 2022, are advised to contact the visa office.
